1. Who you are contracting with
Township Pulse, trading as MzansiLingua ("the Academy", "we", "us"), operates this online language school from 5th Avenue, Parkhurst, 2193, Johannesburg, South Africa. When you register for a course, buy a lesson pack, a membership or a book, you enter into an agreement with Township Pulse.
2. Acceptance of these terms
By creating an account, taking a trial lesson, purchasing lessons or materials, or otherwise continuing to use the website, you agree to these terms. If you are registering on behalf of an organisation or a child, you confirm that you have the authority to do so; individual learners must be of legal age or registered by a parent or guardian.
3. What we provide
Online lessons in South African languages, Swahili, mining Fanakalo and township street language, together with quizzes, games, pronunciation practice, placement tests, workbooks, bilingual phrase books and dictionaries, and children's readers. Access depends on the lesson pack, membership or item you have purchased.
4. Your account
You must give accurate registration information and keep it up to date. You are responsible for keeping your login credentials confidential and for all activity that takes place under your account.
5. Acceptable use
You may not use the Academy unlawfully; commit fraud; send spam; infringe anyone's intellectual property; upload malware; probe, scan or interfere with the security of the service; scrape the site; share your account with others; or resell, redistribute or publish our lessons, audio, workbooks or books.
6. Intellectual property
All lessons, audio, illustrations, workbooks, phrase books, dictionaries, children's readers, software and branding remain the property of the Academy. You receive a limited, non-exclusive, non-transferable right to use the materials for your own personal learning within the plan you purchased. Downloaded materials may be printed for personal use only. Reverse engineering, resale and circumvention of technical limits are not permitted.
7. Service level
We work to keep the Academy available and accurate, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, all implied warranties, including merchantability and fitness for a particular purpose, are disclaimed.
8. Payment, billing, tax and subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing frequency, taxes, currency, cancellations and refunds are governed by the Paddle Buyer Terms. Memberships renew automatically until cancelled; cancelling stops future renewals and your access runs to the end of the period you have already paid for. Prices are shown on our pricing page.
9. Refunds
See our refund policy. We offer a 30-day money-back guarantee on purchases.
10. Suspension and termination
We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your access to lessons ends; materials you have already downloaded remain yours to keep for personal use.
11. Liability
To the extent permitted by law, our aggregate liability is limited to the fees you paid in the twelve months before the claim. We exclude liability for indirect, consequential or special damages, including loss of profits, data or goodwill. Nothing excludes liability for fraud, death or personal injury caused by our negligence.
12. Indemnity
You indemnify the Academy against claims arising from your unlawful use of the service, the content you submit, or your breach of these terms.
13. Governing law and disputes
These terms are governed by the laws of the Republic of South Africa, and the courts of South Africa have jurisdiction. We ask that you contact us first so that we can try to resolve any dispute directly.
14. Changes, assignment and force majeure
We may update these terms and will post the revised version on this page. You may not assign your rights without our consent; we may assign in connection with a merger or acquisition. Neither party is liable for delays caused by events beyond reasonable control.
